Employee entitled to PHI benefits until he could return to the same job with the employer

In a recent case, the Employment Appeal Tribunal decided that an employee would have been entitled to benefits under a permanent health insurance (PHI) scheme until his death or retirement, had he not been dismissed.  This was on the basis that he could not return to the same work he had been doing with the employer when he went on sick leave.  

Therefore, the employee would continue to receive benefits until the earlier of his return to work, his death or retirement under the policy.
